Terms and Conditions

Welcome to Pugsley Court Agents (“PCA,” “we,” “our,” or “us”). By accessing our website or engaging our services, you agree to be bound by the following Terms and Conditions.

1. Scope of Services

Pugsley Court Agents provides legal support and court-related services both within Canada and internationally, including in the United States, the United Kingdom, Ireland, Australia, and other jurisdictions where services may be requested. Services include, but are not limited to:

  • Coordination and facilitation of service of legal documents (process serving)
  • Intake management, instructions, timelines, and client communications
  • Coordination of third-party process servers and legal support providers
  • Obtaining, reviewing, and delivering affidavits or certificates of service
  • Skip tracing, document retrieval, court filings, and other administrative court services (where offered)

PCA does not provide legal advice, legal opinions, or legal representation.

Some services may be performed directly by PCA. Many services—particularly physical service of documents—are performed by independent third-party contractors.

2. Client Responsibilities

Clients are solely responsible for:

  • Providing accurate, complete, and lawful documents
  • Supplying valid, current, and serviceable addresses
  • Disclosing deadlines, urgency, court rules, and jurisdiction-specific requirements
  • Confirming whether alternative or substituted service is permitted

PCA is not responsible for delays, failed service, or adverse outcomes caused by inaccurate information, inaccessible recipients, evasive behaviour, or court-imposed constraints.

3. Third-Party Contractors

Most physical service of process and certain ancillary services are performed by independent contractors, not employees or agents of PCA.

While PCA exercises reasonable care in selecting and coordinating third-party providers, PCA is not liable for the acts or omissions of independent contractors, except to the extent required by applicable law.

4. Service Standards & Timelines

  • Standard service is typically completed within 3–5 business days, where available
  • Rush or same-day service may be available in select locations
  • Rural, remote, high-risk, or international service may require additional time or fees

All timelines are estimates only, not guarantees. Court deadlines remain the sole responsibility of the client.

5. Fees, Payments & Billing

Fees are based on factors including location, urgency, number of attempts, contractor costs, jurisdictional complexity, and special instructions.

Upfront Payment (Default): Payment is typically required in full before service is initiated. Once payment is received, PCA will proceed with coordination and dispatch.

Post-Service Invoicing (Approved Clients): Law firms, corporate clients, and government entities may, at PCA’s discretion, be approved for post-service invoicing. Approval may be revoked at any time.

  • Invoices are due within fifteen (15) days of issuance
  • Late payment may result in suspension or refusal of future services

Additional Costs: If unforeseen circumstances arise (including evasion, incorrect addresses, additional attempts, jurisdictional complications, or special instructions) that materially increase costs, PCA reserves the right to issue a supplemental invoice. Any additional charges will be communicated as soon as reasonably practicable.

6. Taxes (Canada and International Services)

Pugsley Court Agents is registered for GST/HST under Canadian law.

  • Canadian GST or HST will be charged on taxable supplies made in Canada, in accordance with Part IX of the Excise Tax Act (Canada) and the applicable place of supply rules
  • Services performed outside Canada are generally not subject to Canadian GST/HST, unless otherwise required by law
  • Where services are performed outside Canada, foreign taxes (including but not limited to VAT, GST, or sales taxes) may apply depending on the jurisdiction
  • Unless expressly stated otherwise: all fees are exclusive of applicable taxes; the client is responsible for payment of any applicable foreign taxes, duties, or assessments imposed by the relevant jurisdiction

PCA does not provide tax advice and makes no representation regarding a client’s tax obligations outside Canada.

7. Proof of Service

Upon completion of service, PCA will provide an affidavit or certificate of service or affidavit of attempted service prepared by the serving party.

Turnaround time may vary depending on jurisdiction, court requirements, and third-party availability. PCA does not guarantee court acceptance of any affidavit or certificate of service.

8. Cancellations & Refunds

  • Cancellations before dispatch may qualify for a partial or full refund, less administrative or coordination costs
  • Cancellations after dispatch or attempted service are non-refundable for work already completed

All refunds are issued at PCA’s discretion and are subject to third-party costs already incurred.

9. Limitation of Liability

PCA is not liable for:

  • Failure or inability to serve a party
  • Legal consequences arising from delayed or unsuccessful service
  • Court rejections, procedural defects, or jurisdictional issues
  • Acts or omissions of third-party contractors outside PCA’s direct control

PCA’s maximum liability, under any circumstance, is limited to the amount paid by the client for the specific service giving rise to the claim.

10. No Legal Advice

PCA is not a law firm. Nothing provided by PCA constitutes legal advice. Clients are encouraged to consult qualified legal counsel regarding procedural or substantive legal matters.

11. Foreign Service Limitations

Court rules, service requirements, timelines, evidentiary standards, and enforcement mechanisms vary by jurisdiction. PCA does not guarantee that service performed outside Canada will meet the procedural requirements of any specific foreign court unless expressly agreed in writing.

Clients are responsible for confirming jurisdiction-specific service requirements and accepting the risks associated with international service.

12. Jurisdiction & Governing Law

These Terms and Conditions are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict of law principles.

13. Changes to Terms

PCA reserves the right to modify these Terms and Conditions at any time. Continued use of our services constitutes acceptance of the updated terms.
